Welcome to SewIndie. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and SewIndie, LLC ("SewIndie," "we," "us," or "our") concerning your access to and use of the SewIndie website and services located at https://www.sewindie.com (collectively, the "Services").

SewIndie is an online directory and community platform for discovering and cataloging independent sewing patterns and their designers.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Services.

1. Eligibility

SewIndie is intended for a general audience and is not specifically directed toward minors.

Users are not required to be 18 years of age or older to use the Services. If you are under the age of majority in your jurisdiction, you should use the Services with the knowledge and permission of a parent or legal guardian where required by applicable law.

You may not use the Services if you are prohibited from doing so under applicable law.

2. Using SewIndie

SewIndie provides a directory for discovering independent sewing patterns and designers.

The Services may allow you to:

• browse and search sewing-pattern listings;
• explore designer profiles;
• save patterns as favorites;
• rate patterns on a one-to-five-star scale;
• submit requests for patterns or designers to be added to the directory; and
• follow links to third-party websites.

Some features require you to create an account. SewIndie may add, modify, suspend, or discontinue features at any time.

SewIndie does not guarantee that every independent sewing pattern or designer is included in the directory.

3. SewIndie Is a Directory, Not a Pattern Seller

SewIndie is an information and directory platform. Unless expressly stated otherwise, SewIndie does not sell, license, manufacture, publish, distribute, or fulfill the sewing patterns listed on the Site.

SewIndie may provide links to independent sewing-pattern designers, retailers, marketplaces, or other third-party websites where patterns may be purchased or obtained.

Any purchase, download, license, refund, exchange, customer-service matter, or other transaction concerning a sewing pattern is between you and the applicable third party.

SewIndie is not a party to those transactions and is not responsible for the products, services, policies, or actions of third parties.

4. Pattern and Designer Information

SewIndie strives to provide useful and accurate information about sewing patterns and designers. However, information displayed on the Services may be incomplete, outdated, inaccurate, or incorrect.

This may include:

• pattern names and descriptions;
• designer information;
• size ranges and measurements;
• fabric recommendations;
• pattern formats;
• difficulty levels;
• pattern availability;
• pricing;
• links;
• categories and attributes; and
• other pattern-related information.

Information may come from pattern designers, publicly available sources, third-party websites, users, or other sources.

SewIndie does not guarantee that information on the Services is complete, current, accurate, or reliable.

Pattern designers may change their patterns, sizing, pricing, websites, availability, or other information after information has been added to SewIndie.

Before purchasing, downloading, printing, or using a sewing pattern, you should verify important information directly with the applicable designer or seller.

You are responsible for determining whether a particular pattern is appropriate for your project, skill level, measurements, materials, and intended use.

5. Designer Profiles and Listings

The appearance of a designer, business, or sewing pattern on SewIndie does not necessarily mean that the designer or business has claimed, verified, endorsed, sponsored, or approved the listing.

Initially, designers do not have the ability to claim or verify profiles directly through SewIndie.

SewIndie may create, update, modify, or remove directory listings at its discretion based on information available to us.

If you are a designer and believe that information in a listing is inaccurate or that material associated with your work should be removed, you may contact us.

6. Your Account

Some features of SewIndie require an account, including ratings and favorites.

When creating an account, you agree to:

• provide accurate information;
• keep your account information reasonably up to date;
• maintain the confidentiality of your password;
• take reasonable steps to protect your account; and
• notify us if you believe your account has been compromised.

You are responsible for activity that occurs through your account, except to the extent that unauthorized activity results from circumstances outside your reasonable control.

You may not:

• create an account using another person's identity;
• provide knowingly false or misleading information;
• use another person's account without authorization;
• sell, transfer, or share your account;
• create multiple accounts for the purpose of manipulating ratings or other features; or
• create a new account to circumvent a suspension or other restriction.

7. Pattern and Designer Requests

SewIndie allows users to submit requests suggesting patterns or designers for inclusion in the directory.

Submitting a request does not guarantee that SewIndie will add the requested pattern or designer.

SewIndie may review, verify, modify, reject, or otherwise evaluate information provided in a request.

SewIndie may obtain or verify information from the applicable designer, publicly available sources, third-party websites, or other sources.

By submitting a request, you represent that the information you provide is accurate to the best of your knowledge and that you are not knowingly submitting fraudulent, misleading, or infringing information.

Submitting a request does not give you ownership of, editorial control over, or any other rights in the SewIndie database or in the pattern or designer being suggested.

SewIndie is not obligated to credit users for pattern or designer requests.

8. Ratings

Registered users may rate sewing patterns on a scale of one to five stars.

Each user may have one active rating for a particular pattern. Users may change their rating at any time.

A pattern's displayed rating is calculated from the ratings submitted by users and may be displayed as an average on a five-star scale.

SewIndie does not independently verify that a user has purchased, downloaded, or sewn a pattern before allowing the user to submit a rating. Ratings therefore represent individual user opinions and may not accurately reflect the quality, fit, difficulty, accuracy, or suitability of a pattern.

You may not:

• create multiple accounts to manipulate ratings;
• submit ratings on behalf of another person without authorization;
• coordinate with other users to artificially increase or decrease a pattern's rating;
• use automated means to submit ratings;
• submit ratings for fraudulent, retaliatory, harassing, or abusive purposes; or
• otherwise attempt to manipulate the rating system.

SewIndie may remove ratings or restrict accounts when we reasonably believe ratings have been submitted fraudulently, abusively, or in violation of these Terms.

9. Favorites

Registered users may save patterns as favorites for their personal use.

Saving or favoriting a pattern does not give you ownership of the pattern or any intellectual-property rights in it.

SewIndie may modify, remove, or discontinue the favorites feature.

10. Intellectual Property

Sewing patterns, photographs, logos, trademarks, descriptions, and other materials belonging to independent designers and other third parties remain the property of their respective owners.

Listing or describing a sewing pattern on SewIndie does not transfer ownership of the pattern or any associated intellectual-property rights to SewIndie.

SewIndie does not claim ownership of third-party intellectual property merely because it is listed or referenced through the Services.

Nothing in these Terms grants you permission to reproduce, distribute, sell, modify, or otherwise use third-party copyrighted material, trademarks, pattern designs, photographs, or other protected materials.

SewIndie owns or licenses the intellectual property associated with its own website, branding, software, database structure, original text, graphics, and other original materials.

You may not reproduce, republish, systematically extract, commercially exploit, or create a competing database from substantial portions of the SewIndie database without our prior written permission.

11. Acceptable Use

You agree not to use the Services to:

• violate any applicable law or regulation;
• impersonate another person, designer, or organization;
• submit fraudulent or knowingly misleading information;
• manipulate ratings or other platform features;
• harass, threaten, stalk, or abuse another person;
• infringe or facilitate infringement of another person's intellectual-property rights;
• introduce viruses, malware, malicious code, or other harmful material;
• attempt to gain unauthorized access to SewIndie accounts, systems, databases, or infrastructure;
• interfere with or disrupt the Services;
• circumvent security measures, access restrictions, or technical limitations;
• use bots, spiders, crawlers, scrapers, scripts, or other automated methods to systematically access or collect information from SewIndie without permission;
• systematically copy or extract substantial portions of the SewIndie database;
• use SewIndie data to create or maintain a competing sewing-pattern directory, database, or service;
• use automated systems to create accounts, submit ratings, or submit requests;
• circumvent a suspension, ban, rate limit, or other restriction imposed by SewIndie; or
• otherwise use the Services in a manner that could damage, disable, overburden, or impair the Services or interfere with another user's use of the Services.

12. Third-Party Websites and Links

SewIndie may contain links to third-party websites operated by sewing-pattern designers, retailers, marketplaces, and other parties.

SewIndie does not control or endorse third-party websites unless expressly stated.

SewIndie is not responsible for:

• third-party content;
• products or services;
• pricing;
• availability;
• security;
• privacy practices;
• terms of use;
• purchases or transactions;
• refunds;
• customer service; or
• pattern quality or accuracy.

Your use of a third-party website is subject to that website's own terms and policies.

13. Copyright and DMCA

SewIndie respects the intellectual-property rights of others.

If you believe material displayed through SewIndie infringes your copyright, please review our DMCA Copyright Policy for information about submitting a copyright complaint.

14. Managing the Services

SewIndie reserves the right, but not the obligation, to:

• review information submitted through the Services;
• correct or remove inaccurate information;
• reject pattern or designer requests;
• remove or restrict ratings;
• restrict access to features;
• block automated or abusive activity;
• investigate suspected violations of these Terms;
• suspend or terminate accounts; and
• take other reasonable action necessary to protect SewIndie, its users, third parties, or the integrity of the Services.

SewIndie is not obligated to monitor every activity or verify every piece of information on the Site.

15. Privacy

Your use of the Services is also subject to the SewIndie Privacy Policy, which explains how we collect, use, store, and disclose personal information.

16. Disclaimer of Warranties

THE SERVICES AND ALL INFORMATION PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SEWINDIE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SewIndie does not warrant that:

• the Services will be uninterrupted or error-free;
• information will be accurate, complete, or current;
• third-party links will remain active;
• third-party websites will be available or secure;
• a listed pattern will remain available;
• a pattern will fit, sew, or perform as expected; or
• ratings will accurately represent the quality or characteristics of a sewing pattern.

You are responsible for independently verifying information that is important to your purchasing or sewing decisions.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEWINDIE, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES ARISING FROM INACCURATE PATTERN INFORMATION, RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICES, THIRD-PARTY WEBSITES, THIRD-PARTY PRODUCTS OR SERVICES, SERVICE INTERRUPTIONS, TECHNICAL FAILURES, OR UNAUTHORIZED ACCESS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEWINDIE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SEWINDIE FOR THE SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless SewIndie, LLC and its members, managers, officers, employees, contractors, agents, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

1. your violation of these Terms;
2. your misuse of the Services;
3. your violation of another person's intellectual-property or other rights;
4. your fraudulent or unlawful use of the Services; or
5. your violation of applicable law.

19. Changes to the Services and These Terms

SewIndie may modify, suspend, or discontinue the Services or any feature at any time.

We may update these Terms from time to time to reflect changes to the Services, our practices, or applicable law.

When we make changes, we will update the "Last updated" date at the beginning of these Terms.

If we make material changes that require notice under applicable law, we will provide appropriate notice through the Services or by other appropriate means.

Your continued use of the Services after revised Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.

20. Termination

You may stop using the Services at any time.

SewIndie may suspend or terminate your account or access to the Services if you violate these Terms or if we reasonably determine that restricting access is necessary to protect the Services, users, or third parties.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions, will survive termination.

21. Governing Law

These Terms and your use of the Services will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent applicable federal law or another mandatory law provides otherwise.

22. Dispute Resolution

Before initiating a formal legal proceeding concerning a dispute arising out of these Terms or the Services, you and SewIndie agree to attempt in good faith to resolve the dispute informally.

You should first contact SewIndie at hello@sewindie.com and provide a description of the dispute and the resolution you are seeking.

SewIndie will have a reasonable opportunity to investigate and attempt to resolve the matter.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief where appropriate to protect intellectual property, prevent unauthorized access to the Services, or address other circumstances in which monetary damages may be inadequate.

23. Miscellaneous

Entire Agreement

These Terms, together with the Privacy Policy and DMCA Copyright Policy where applicable, constitute the agreements governing your use of the Services.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will remain in effect.

No Waiver

SewIndie's failure to enforce a provision of these Terms does not constitute a waiver of its right to enforce that provision later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without SewIndie's prior written consent.

SewIndie may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or similar business transaction.

No Agency

These Terms do not create a partnership, joint venture, employment, agency, or franchise relationship between you and SewIndie.
