SewIndie, LLC ("SewIndie," "we," "us," or "our") respects the intellectual-property rights of others and expects users of our website to do the same.
This DMCA Copyright Policy explains how copyright owners and their authorized representatives can notify SewIndie of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").
This policy applies to the SewIndie website and services located at https://www.sewindie.com (collectively, the "Services").

The designated-agent information above should remain consistent with the information registered with the U.S. Copyright Office. Service providers seeking the protection of the DMCA safe harbor must maintain current and accurate designated-agent information both with the U.S. Copyright Office and on their website.
2. Submitting a DMCA Copyright Notice
If you believe that material available through SewIndie infringes your copyright, you may submit a written notification of claimed infringement to our designated DMCA agent.
For a notification to be effective under the DMCA, it should substantially include the following information:
- Identification of the copyrighted work that you claim has been infringed. If your notice concerns multiple copyrighted works, you may provide a representative list of those works.
- Identification of the allegedly infringing material and information reasonably sufficient for SewIndie to locate the material. For material appearing on the SewIndie website, please provide the relevant page URL or other information that will allow us to identify the material.
- Your contact information, including your name, mailing address, telephone number, and email address, if available.
- A good-faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement made under penalty of perjury that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
The U.S. Copyright Office identifies these elements as the information generally required for an effective DMCA notification under 17 U.S.C. § 512(c)(3).
3. What Happens After We Receive a Notice
When SewIndie receives a substantially compliant DMCA notification, we may investigate the complaint and take appropriate action, which may include removing or disabling access to material that is the subject of the complaint.
Because SewIndie is primarily a directory and information service, an alleged copyright issue may involve information, images, links, or other material displayed on a pattern or designer listing.
Depending on the circumstances, SewIndie may:
- remove or modify material;
- disable access to material;
- remove a link;
- temporarily restrict access to a listing;
- contact the person or entity associated with the material;
- request additional information from the complaining party; or
- take other action appropriate under applicable law.
We do not guarantee that every complaint will result in removal of the identified material.
SewIndie may also consider whether the material is authorized, licensed, in the public domain, protected by an applicable exception to copyright, or otherwise not infringing.
4. Counter-Notification
If SewIndie removes or disables access to material in response to a DMCA notification, the affected party may be entitled to submit a DMCA counter-notification.
A counter-notification should be submitted in writing to our designated DMCA agent and should generally include:
- Identification of the material that was removed or disabled and the location where the material appeared before removal.
- A statement under penalty of perjury that the sender has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The sender's name, address, and telephone number.
- A statement consenting to the jurisdiction of the applicable federal district court and accepting service of process from the person who submitted the original notification or that person's agent.
- The sender's physical or electronic signature.
Upon receipt of a valid counter-notification, SewIndie may follow the counter-notification procedures provided by the DMCA, including notifying the original complaining party.
The DMCA provides specific timelines and requirements governing restoration of material following a valid counter-notification.
5. Repeat Infringers
Where appropriate and consistent with applicable law, SewIndie may restrict or terminate accounts or access belonging to users who are determined to be repeat copyright infringers.
SewIndie may also take other reasonable measures to prevent repeated infringement through the Services.
6. Misrepresentations
Please do not submit a false or materially misleading copyright complaint or counter-notification.
The DMCA provides potential liability for knowingly materially misrepresenting that material or activity is infringing or was removed or disabled by mistake or misidentification.
If you are uncertain whether material infringes your copyright, you should consider obtaining legal advice before submitting a DMCA notification.
7. Copyright Issues Involving Third-Party Websites
SewIndie may provide links to sewing-pattern designers, retailers, marketplaces, and other third-party websites.
SewIndie does not control material hosted exclusively on third-party websites.
If your copyright complaint concerns material hosted on another website rather than material provided through SewIndie's Services, you should generally contact the operator of that website or its designated DMCA agent.
A link from SewIndie to a third-party website does not mean that SewIndie hosts or controls the material located on that third-party website.
8. Pattern Designers and Copyright
SewIndie is an information and directory platform for independent sewing patterns.
Listing or describing a sewing pattern on SewIndie does not transfer ownership of the pattern or any associated intellectual-property rights to SewIndie.
Pattern designers and other copyright owners retain their rights in their original creative works.
If you are a pattern designer or copyright owner and believe that SewIndie is displaying copyrighted material without authorization, you may use the DMCA notification process described above.
